1. Agreement to Terms

By accessing the Divya Express platform and booking a shipment, you agree to be bound by these Terms and Conditions and our Privacy Policy. These terms apply to all visitors, users, and others who access or use the Service.

2. Payment & Financial Terms

To use our shipping services, you must provide valid payment information. By submitting such information, you grant Divya Express the right to provide the information to third-party payment processors to facilitate the transaction.

• Authorization: You authorize Divya Express to charge all sums for the orders you make to the payment method specified at the time of booking.
• Weight Discrepancies: If the actual weight or dimensions of the shipment exceed the declared amount, you agree to pay the difference via a supplemental invoice before delivery is completed.

3. Prohibited Items & Compliance

Customers are strictly prohibited from shipping items that are illegal, hazardous, or restricted by aviation law. Prohibited items include, but are not limited to:

• Hazardous materials, explosives, or flammable liquids.
• Illegal drugs, narcotics, or psychotropic substances.
• Currency, bullion, or high-value jewelry (unless declared and insured).
• Perishable items without prior refrigerated logistics arrangement.

Divya Express reserves the right to inspect any package and refuse or discard shipments that violate these terms without liability.

4. Limitation of Liability

Divya Express acts as a facilitator for logistics. We are not liable for losses or delays caused by events outside our control (Force Majeure), including but not limited to weather, or incorrect documentation provided by the user.

Disclaimer: To the maximum extent permitted by applicable law, Divya Express shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly by the User/Customer.

5. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Divya Express and its licensors. Our trademarks, logos, and trade dress may not be used in connection with any product or service without the prior written consent of the Company. Any unauthorized use of the materials appearing on this site may violate copyright, trademark, and other applicable laws.

6. User Account Security & Termination

If you create an account on our platform, you are responsible for maintaining the confidentiality of your credentials. You agree to accept responsibility for all activities or actions that occur under your account.

Termination by Company: We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Termination by User: You may terminate your account at any time by discontinuing the use of our services or contacting our support team. Upon termination, all provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

7. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, India.
